End User License Agreement (EULA) and Terms of Use — Open When: Verses
These End User License Agreement and Terms of Use (“Terms”) govern your use of Open When: Verses (the “App”), provided by Vanessa Lucena (“we”, “us”, or “our”). By downloading, accessing, or using the App, you agree to these Terms.
Who can use the App
Open When: Verses is designed to offer Bible verses matched to emotions, helping users find comfort, encouragement, and reflection through scripture.
The App is not directed to children under 13. If you are under the age required to enter into legal agreements in your country, a parent or legal guardian must review and agree to these Terms on your behalf and supervise any subscription activity.
Licence to use the App
We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App for your own non-commercial purposes, subject to these Terms and applicable law.
You agree not to:
- copy, modify, distribute, sell, lease, sublicense, or commercially exploit any part of the App;
- reverse engineer, decompile, or attempt to extract the source code of the App, except where permitted by law;
- misuse the App or interfere with its normal operation;
- use the App in any unlawful, harmful, or abusive way.
Your content
You may save favourite verses and set a display name within the App.
Your content is stored on your device using Apple’s on-device storage. You are responsible for any content you create, save, or choose to share through the App’s sharing features.
Subscriptions and billing
Open When: Verses may offer paid features through auto-renewable subscriptions, including optional free trials where offered.
Subscription prices, billing periods, local pricing, and trial availability are shown in the App and are managed by Apple. Prices and availability may vary by country or region.
For subscriptions:
- payment is charged to your Apple ID account at confirmation of purchase, or at the end of any applicable free trial if you do not cancel in time;
- unless cancelled before the end of the current billing period or free trial, the subscription automatically renews;
- Apple may charge for renewal within 24 hours before the end of the current period;
- you can manage or cancel your subscription at any time in your Apple ID account settings after purchase.
Free trials
Where offered, free trials apply only for the period shown in the App. Unless cancelled before the end of the free trial, the selected subscription will automatically convert into a paid subscription and renew according to Apple’s billing cycle.
RevenueCat (subscription management service)
We use RevenueCat to help manage subscription status and entitlements. RevenueCat may process purchase receipts, subscription status, technical identifiers, and related data needed to manage entitlements, improve reliability, and help prevent fraud or abuse.
Payments are processed by Apple. We do not receive or store your full payment card details.
Refunds
Refunds are handled by Apple, not by us. If you believe you may be entitled to a refund, please contact Apple directly through your Apple account or Apple Support.
Availability and changes
We may update the App, modify features, or discontinue some or all of the App at any time. We do not guarantee that the App will always be available, uninterrupted, secure, or error-free.
Intellectual property
The App, including its code, design, branding, graphics, and content provided by us, is owned by Vanessa Lucena or licensed to us and is protected by applicable intellectual property laws.
These Terms do not give you ownership of the App or any of its intellectual property.
Bible verse content displayed in the App is sourced from public domain translations.
Disclaimer
The App is provided “as is” and “as available”, to the fullest extent permitted by law. We do not make any warranties, whether express or implied, including any warranties of merchantability, fitness for a particular purpose, and non-infringement.
The App is intended for personal encouragement and reflection only. It is not a substitute for professional counselling, mental health support, medical advice, or spiritual guidance from a qualified professional, pastor, or counsellor.
Limitation of liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful.
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, goodwill, or other losses arising from your use of the App.
Termination
You may stop using the App at any time.
We may suspend or terminate your access to the App if you materially or repeatedly breach these Terms or misuse the App.
Governing law
These Terms are governed by the laws of England and Wales, unless the consumer protection laws of your country of residence require otherwise.
